These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Murriel Toussaint Michel Executives, Inc., doing business as MTM Executives (“MTM Executives,” “we,” “us,” or “our”), concerning your access to and use of the mtmexecutives.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site, you confirm that you have read, understood, and agree to be bound by all these Terms of Use. IF YOU DO NOT AGREE WITH ALL THESE TERMS OF USE, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY.
We reserve the right to modify these Terms of Use at any time. We will notify you of any changes by updating the “Last Updated” date, and you waive any right to receive specific notice of each such change. Continued use of the Site constitutes your acceptance of any revised Terms of Use.
Unless otherwise specified in writing, all invoices are due upon receipt.
If payment is not received:
- A 10% late payment fee may be applied to outstanding balances.
- MTM Executives reserves the right to pause or terminate ongoing services without prior notice.
- If a payment remains outstanding beyond 60 days, and the balance due is $500 or more, MTM Executives may refer the matter to a collections agency, with all legal and administrative costs borne by the Client.
These Terms of Use and any contractual agreements with MTM Executives shall be governed exclusively by the laws of the Commonwealth of Massachusetts, United States. Any disputes shall be resolved in the appropriate courts within Massachusetts unless otherwise agreed in writing.
Binding Arbitration
If informal negotiations fail, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will take place in Middlesex County, Massachusetts, unless otherwise agreed.
Exceptions to Arbitration
The following disputes are not subject to arbitration:
- Any disputes concerning intellectual property rights.
- Allegations of theft, piracy, or unauthorized use.
- Claims for injunctive relief.
If any provision of this arbitration agreement is found to be unenforceable, disputes will be resolved in state and federal courts in Massachusetts.
